Zyom, Inc. has created this Privacy Policy ("Privacy Policy") to demonstrate our commitment to user and visitor privacy. Privacy on the Zyom, Inc. web site (the "Site") and within the services (the "Services") delivered by Zyom, Inc. to our users is of utmost importance to us. This Privacy Policy describes our information-gathering and dissemination practices. By visiting the Site or using the Services, you are agreeing to the collection and use of information in the manner described below.

Personal Data collection

If you express an interest in obtaining additional information about our services, request customer support, use our "Contact us" section, register to use our website, sign up for an event, webinar or contest, or download certain content, we may require that you provide to us your contact information, such as your name, company name, address/country, phone number, and email address.

If you use and interact with our websites or emails, we automatically collect information about your device and your usage of our websites or emails through cookies, or similar technologies, such as Internet Protocol (IP) addresses or other identifiers, which may qualify as Personal Data

If you provide us or our service providers with any Personal Data relating to other individuals, you represent that you have the authority to do so and acknowledge that it will be used in accordance with this Privacy Statement. What device and usage data we process?

As is true of most websites, we gather certain information automatically on connection with the use of the website by individual users. This information may include IP address (or proxy server), device and application identification numbers, location, browser type, Internet service provider and/or mobile carrier, the pages and files viewed, searches, operating system and system configuration information and date/time stamps associated with your usage. This information is used to analyze overall trends, to help us provide and improve our websites and to guarantee their security and continued proper functioning.

Providing our websites and services: We process your Personal Data to perform our contract with you for the use of our websites and services and to fulfill our obligations under applicable terms of use/service; where we have not entered into a contract with you, we base the processing of your Personal Data on our legitimate interest to operate and administer our websites and to provide you with content you access and request (e.g., to download content from our websites)

Managing user registrations: If you have registered for an account with us, we process your Personal Data by managing your user account for the purpose of performing our contract with you according to applicable terms of service

Handling contact and user support requests: If you fill out a “Contact Us web form or request user support, or if you contact us by other means including via a phone call, we process your Personal Data to perform our contract with you and to the extent it is necessary for our legitimate interest in fulfilling your requests and communicating with you

Managing event registrations and attendance: We process your Personal Data to plan and host events or webinars for which you have registered or that you attend, including sending related communications to you, to perform of our contract with you

Managing contests or promotions: If you register for a contest or promotion, we process your Personal Data to perform our contract with you. Some contests or promotions have additional rules containing information about how we will process your Personal Data

Assessing and improving user experience: We process device and usage data as described in the section above, which in some cases may be associated with your Personal Data, in order to analyze trends in order to assess and improve the overall user experience to the extent it is necessary for our legitimate interest in developing and improving the service offering, or where we seek your valid consent

Sending marketing communications: We will process your Personal Data to send you marketing information, product recommendations and other non-transactional communications (e.g., marketing newsletters, telemarketing calls, SMS, or push notifications) about us and our affiliates and partners, including information about our products, promotions or events as necessary for our legitimate interest in conducting direct marketing or to the extent you have provided your prior consent

Who do we share Personal Data with?

We don't share with anyone else. All your information will be kept inside of Zyom, Inc. and will be used for internal purposes only.

Children

Our websites are not directed at children. We do not knowingly collect Personal Data from children under the age of 16. If you are a parent or guardian and believe your child has provided us with Personal Data without your consent, please contact us by using the information in the “Contact us” section, and we will take steps to delete such Personal Data from our systems.

How long do we keep your Personal Data?

We may retain your Personal Data for a period of time consistent with the original purpose of collection. We determine the appropriate retention period for Personal Data on the basis of the amount, nature and sensitivity of your Personal Data processed, the potential risk of harm from unauthorized use or disclosure of your Personal Data and whether we can achieve the purposes of the processing through other means, as well as on the basis of applicable legal requirements (such as applicable statutes of limitation). After expiry of the applicable retention periods, your Personal Data will be deleted. If there is any data that we are unable, for technical reasons, to delete entirely from our systems, we will put in place appropriate measures to prevent any further use of such data.

Your rights relating to your Personal Data

You have certain rights relating to your Personal Data, subject to local data protection laws. Depending on the applicable laws and, in particular, if you are located in the EEA, these rights may include:
- To access your Personal Data held by us (right to access)
- To rectify inaccurate Personal Data and, taking into account the purpose of processing the Personal Data, ensure it is complete (right to rectification)
- To erase/delete your Personal Data, to the extent permitted by applicable data protection laws (right to erasure; right to be forgotten);
- To restrict our processing of your Personal Data, to the extent permitted by law (right to restriction of processing);
- To transfer your Personal Data to another controller, to the extent possible (right to data portability);
- To object to any processing of your Personal Data carried out on the basis of our legitimate interests (right to object). Where we process your Personal Data for direct marketing purposes or share it with third parties for their own direct marketing purposes, you can exercise your right to object at any time to such processing without having to provide any specific reason for such objection;
- Not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects ("Automated Decision-Making"). Automated Decision-Making currently does not take place on our websites or in our services; and
- To the extent we base the collection, processing and sharing of your Personal Data on your consent, to withdraw your consent at any time, without affecting the lawfulness of the processing based on such consent before its withdrawal.

How to exercise your rights
To exercise your rights, please contact us by using the information in the “Contact us” section. We try to respond to all legitimate requests within one month and will contact you if we need additional information from you in order to honor your request. Occasionally it may take us longer than a month, taking into account the complexity and number of requests we receive. If you are an employee of a Zyom customer, we recommend you contact your company’s system administrator for assistance in correcting or updating your information.

How we secure your Personal Data?

We take precautions including organizational, technical and physical measures to help safeguard against the accidental or unlawful destruction, loss, alteration and unauthorized disclosure of, or access to, the Personal Data we process or use. While we follow generally accepted standards to protect Personal Data, no method of storage or transmission is 100% secure. You are solely responsible for protecting your password, limiting access to your devices and signing out of websites after your sessions. Information Gathered

Registration and Billing Information: When a visitor to the Site registers to become a user of the Services or requests more information about the Services, we require that the visitor provide contact information such as their name, e-mail address and company name and, when applicable, billing information such as billing address and credit card number. Zyom currently does not utilize credit card payments. We may also ask visitors, users, or prospective users of the Services for additional personal information such as title, department name, phone number, or additional company information such as annual revenues, number of employees or industry. No personal data is saved on the Zyom's website. Zyom's MozartCC system and services store minimal user specific data for accessing the system and utilizing Zyom's services only.

Users and visitors can opt out of providing this additional information by not entering it when asked. However, failure to provide certain requested information may impact a user’s or a visitor’s ability to access the Site and Services.

Log Data and Activity Tracking: Zyom, Inc., collects certain information from visitors to the Site and users of the Services, such as Internet addresses, browser types, referring domains, time stamps (time page accessed as well as time spent per web page), geographic information, search engine data, order of pages viewed as well as the specific pages the visitor has requested. This information is logged for marketing purposes and to help diagnose technical problems and administer the Site and the Services in order to constantly improve the quality of the Services. We may also track and analyze non-identifying activity and aggregate usage-and-volume statistical information from visitors and users, and provide such information to third parties. See next section on Cookies.

Cookies & Web Storage: Zyom's MozartCC System makes use of Cookies and Web Storage for the sole purpose of using our web-native system only and for better user experience. Following explains what Cookies and Web-Storage are used for.
Cookies: A Cookie is a small piece of data sent from a server and stored on the user's computer by the web browser. Cookies will be sent back to the server along with each request. Zyom, Inc. doesn't use cookies other than for session handling.
Web Storage: Compared with Cookies, Web storage is more secure, and large amounts of data can be stored locally, without affecting performance. Unlike cookies, the information is never transferred to the server. Web storage is managed per origin (per domain and protocol). All pages, from one origin, can store and access the same data. HTML web storage provides two modes for storing data on the client:
Local Storage - stores data with no expiration date
Session Storage - stores data for one session
Zyom, Inc. extensively use Web Storage to manage user preferences (input selections etc.) to make user experience better.

Invite a Third Party: If a user elects to invite a third party to review and provide input on the data it has entered as part of the Services, then the user will need to provide the name and e-mail address of each such third party. Zyom, Inc., will automatically send the third party an e-mail inviting him or her to become a user in order to review and provide input on the requesting user’s data. We may also call the third party with information about our products and services.

Information Use
Zyom, Inc., uses the information that we collect to set up the Services for users and to improve the Site. We may also use the information to contact users and visitors to further discuss their interest in the Site and the Services, or to send users and visitors information regarding Zyom, Inc., or its partners, such as promotions and events. To opt out of receiving such information, users and visitors can send an email to support@zyom.com with the word “unsubscribe” in the subject field. We may also e-mail to users information regarding updates to the Services or the Site.

All financial and billing information collected through the Site is used solely to check the qualifications of prospective users and to bill for the Services. This billing information is not used by Zyom, Inc., for marketing or promotional purposes. Other third parties, such as content providers, may provide content on the Site or the Services, but they are not permitted to collect any information, except as provided in the Sharing of Information section below. To facilitate mailings to our users and visitors, Zyom, Inc., may provide the necessary mailing information to bonded third-party contractors who perform the mailing on our behalf.

Stored Data
Users of the Services will be using the Services to store data. Such data may at times be viewed or accessed by Zyom, Inc., only for the purpose of resolving a problem, support issue or suspected violation of the Terms of Use for the Site and the Services, or as may be required by law. Users are responsible for maintaining the confidentiality and security of their user registration and password. Except as provided in this Privacy Policy, Zyom, Inc., will not review, share, distribute, print or reference any data stored by users on the Site or the Services.

Sharing of Information
Zyom, Inc., may share aggregated demographic information with partners and advertisers. This is not linked to any personal information that can identify an individual person.

Zyom, Inc., may use a credit card processing company to bill users for Services. This company will not retain, share, store or use personally identifiable information for any purpose other than as needed to perform such billing.

Zyom, Inc., may partner with other parties to provide specific events, materials or services. If a user registers for these events or elects to receive such materials or services, we may share names and other contact information that is necessary for the third party to provide these events, materials or services. In addition, Zyom, Inc., may provide the third party such other information as a user provides to Zyom, Inc., in connection with the specific event, material or service.

From time to time we may provide information about users to Zyom, Inc.,’ subsidiaries and joint ventures in order to provide those users the Services. Each of these entities will comply with the policies described in this Privacy Policy. In addition, if the stock or assets of Zyom, Inc., its subsidiaries, its joint ventures or any combination of such are acquired by another entity, some or all of Zyom, Inc.,’ users’ and visitors’ personal information and hosted data may be provided to such successor. In such a case, the successor will handle the personal information and hosted data in the same manner as provided in this Privacy Policy. Please see our Notice of Changes section below.

Other than as expressly described in this Privacy Policy, Zyom, Inc., will not share, sell or rent a user’s or a visitor’s personally identifiable information or hosted data with anyone outside of Zyom, Inc.,, without such user’s or visitor’s prior permission or unless ordered by a court of law.

Links to Other Sites The Site and the Services contains links to other sites. Zyom, Inc., is not responsible for the privacy practices of such other sites. We encourage Zyom, Inc., users to be aware when they leave the Site or the Services and to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by the Site and the Services.

Security
Zyom, Inc., takes every precaution to protect our users’ and visitors’ information and data against loss, misuse and alteration. As a web-native application, our success will be predicated on the security of that information and data. We use standard industry practices as outlined in our security statement to help prevent unauthorized use of, access to or alteration of visitor and user information and hosted data. These practices include the appropriate use of firewalls, SSL encryption, system redundancies, and a 24x7 secured, controlled environment via a world-class Cloud infrastructure provider, with their own security protocols, processes and capabilities.

Zyom, Inc., personnel with access to information gathered from visitors and users have been advised of the importance of maintaining the confidentiality of such information and of using it only for the purposes described in this Privacy Policy.

Choice/Opt-out
Whenever visitors or users submit requests for more information or services from us, they may opt out of entering certain fields. However, such decision may affect the ability to use portions of the Site and the Services. If you receive marketing or similar e-mail messages from us and wish to opt out of receiving such messages, then you may simply follow the opt-out procedure specified in such e-mail.

Updating Contact Information
We encourage our visitors and users to update and edit their contact information and keep it current. Users can easily correct or update their contact information at any time through the Services or by emailing support@zyom.com.

Notice of Changes
Zyom, Inc., may amend this Privacy Policy from time to time. If Zyom, Inc., is going to use your personally identifiable information in a manner different from that stated at the time of collection we will notify you via email. You will have a choice as to whether or not we use your information in this different manner. In addition, if we make any material changes in our privacy practices that do not affect visitor or user information already stored in our database, we will post a prominent notice on the Site or in the Services notifying users of the change. In some cases where we post the notice, we will also email users who have opted to receive communications from us notifying them of the changes in our privacy practices.
